General Terms & Conditions for booking with Yolanda Goncalves Photography Art:

 

 

 

Booking & Session Fees:

All quotations are valid for 7days only. There is a £50 non-refundable booking fee per session payable within 48hrs of accepting the quotation. Your session will only be secured upon receiving this payment. The photographer cannot guarantee to have the date available for you if payment has not been received in time.

The balance is due at least 3 days prior to the session. It is the responsibility of the client to ensure payment arrives in time. Non-payment may result in photographer not attending and client will forfeit any monies already paid.

 

Session Fee is inclusive of:

Initial pre-session consultation via telephone or email,

Photographer's time, expertise and creative skill for the duration of the session,

Use of photographer's props as and when needed,

Retouching time and post-processing skills,

Password protected online viewing gallery of best images,

Facebook preview and blog presence (optional),

10 High Resolution Digital Images on branded USB with printing rights up to 8”x10”

Travel up to 15miles from SP11 6GR

 

Session Fee does not include:

Any products, wall art, prints or digital files.

These are all available to purchase seperately.

Travel surcharge of 45p per mile for areas over 15miles from Andover

 

Postponements, Cancellations or Illness

In the event that you cannot attend your session due to any reason, please inform the photographer of this as soon as possible, in any event, more than two days notice will allow you to change it to another available date (one change allowed only) within a 12month period, less than 48hrs notice will result in you forfeiting your booking fee and another booking fee will need to be paid should you wish to book another date.

The session fee (and travel fee where applicable) as a whole is non-refundable once session has taken place, regardless if you would like to purchase any images or not.

If the client decides to cancel the session for any reason within any time prior to the session, the booking fee will be forfeited. Any other monies already paid will be refunded.

In the event that the photographer needs to cancel/postpone your session due to illness or personal matters, an alternative date or full refund of monies paid may be offered.

All outdoor sessions are weather permitting and the photographer reserves the right to postpone any session at any time up to and including the day of the session due to weather conditions. An alternative day will be offered to reschedule for the soonest available date to suit both the client and the photographer.

 

Session Duration & Subject Willingness & Photographer's Equipment and Props

Session duration guidelines are stipulated on the photographer's website under 'Investment Fees', depending on session (eg. Newborn or Maternity). The photographer is only contracted to stay for this amount of time, so it is important to give your full cooperation to ensure that the session runs smoothly. Please ensure that all subjects to be photographed are ready upon arrival of the photographer. If the session is to take place in your home, please make sure that the area where the shoot is to take place is clear from any heavy furniture or clutter prior to photographer's arrival.

The photographer will aim to arrive in good time for your session. If, due to some circumstance beyond photographer's control (eg. traffic delays, car breakdown) the photographer anticipates that she may be late or unable to attend at all, she will inform the client as soon as possible, and when safe to do so eg. Not whilst driving

The client understands that, even though every effort will be made to get the planned poses and setups, the success of the images will ultimately depend on the willingness of the subjects photographed. This is especially true when dealing with babies and young children. Please refrain from scoulding at kids at this time. We will try to find a way together to get lovely images. If not, we may have to reschedule for another day.

The photographer will be carrying many expensive photography gear and props to the session. It is the client's duty to make sure that these gear or props are not maliciously played with by any children present due to safety risks and the risk of items being damaged. Any damage to any equipment or props may be charged to the client.

 

End of Session:

The photographer will present and explain to you the Client Release Agreement form which needs to be carefully read through and signed by the client. The terms and conditions set out in the Client Release Agreement will be additional to this General Terms & Conditions and will not replace each other in any way.

This will also be the time to inform the photographer of any scars/birthmarks/moles you may not wish to have removed during retouching.

 

Gallery:

A photographer's retouching style is as much part of their art as the actual photograph. Please expect to wait up to 30 days (in less busy times) and up to 60 days (during busier periods) for your online viewing gallery to be accessible. The photographer is working hard to make each image into a perfect piece of display-worthy art for you. If you need to rush the photographer your images may not be as amazing as it could!

Once your viewing gallery is ready, the photographer will email you a direct link and password to access the gallery.

Please note: Your online viewing gallery will be available for 30 days from date of upload. Should you wish to order any prints, products or digital package, kindly ensure you do so before your gallery expires. Once the gallery had expired there will be a £20 re-uploading fee should you require access.

 

Use of Social Media/Blog/Online Gallery Images:

The photographer may post a 'Sneak Peek' image on social media platforms, such as Facebook, Twitter, Instagram or Google+ shortly after your session. These images are watermarked with photographer's logo and in low resolution, so will not print to a good standard. Please feel free to tag yourself and share with family and friends, but please DO NOT crop the image, remove the watermark or apply any 'photo effects' or 'image filters' to these images.

The photographer may choose to blog about your session too. Again, please feel free to share the blog link with your loved ones so they too may enjoy reading about your session.

Your online viewing gallery is there for your viewing pleasure to select your favourite images from and even though the images in your gallery will be high resolution, the image size may set smaller than needed for printing quality, and there will be a visible watermark across the images. Please do not attempt to download or print the images from the gallery.

 

Backing-up and Safeguarding of Image Files:

Once the photographer has selected the best images from your session and exported them for retouching, the RAW image files will be deleted. Although the photographer will aim to back-up and keep the JPEG files safe for up to 2 years, there is no guarantee that files will be accessible, as one cannot predict the future or stop hard-drives from failing. Please also note that there will be a location fee of £20 to search for the files after it has been archived (usually 30days after gallery expired).

It is also important, when purchasing image files on a USB or disc, to make sure that you back them up as there is no life-long guarantee with digital files or devices. The photographer will not accept any liability for loss of image files or damage to your USB or disc due to misuse/incorrect use or any other cause, unless it can be proven within 30days that the product was received faulty. In this case, the device will need to be returned to the photographer to be inspected and replaced if need be. There will be no refunds for digital files, but the photographer may offer a replacement USB.

 

 

 

 

 

Products:

All products are considered bespoke and will be of the highest standard as I only use the very best professional providers in the UK and EU.

No product will be refunded unless faulty or damaged upon arrival and replacement is not possible. In such a case, the damaged item will remain with/need to be returned to the photographer to take it up with the lab/service provider and a replacement product of same description arranged.

 

 

 

Additional Services/Requests & Information:

 

I can:

Offer discount on multiple sessions which will be paid altogether in advance – just ask.

Add digital art or Word Art to images, at an additional charge, depending on the request and as long as it complements my artistic style.

Crop images/apply further editing upon request for an additional fee of £10 per image.

Offer superb quality, professional prints and wall display products which will last for many years.

Offer Sunday and Bank Holiday Sessions (if available) at an additional charge of £100 added to any session fee.

 

I will:

Put my heart and soul into your session and post-processing of your images to ensure a pleasant experience and fantastic quality in line with my artistic style.

Provide client will printing rights in the form of a 'Print Release' document for all digital images purchased. Please note that 'printing rights' will allow you to print the images at your own leisure at a lab of your choice however, this does not assign the copyright to you. Copyright remains with the photographer.

 

 

I won't:

Under any circumstance give any unedited and/or RAW files. Please don't ask.

Discount my prices (with the exception of multiple sessions paid in advance) or include freebies. This is non-negotiable.

Be held responsible for quality of any prints or products not ordered via myself.

Place any product/print orders with my providers/photography labs unless funds have cleared my account.

Transfer or dispatch in any form, any digital images unless funds cleared my account.
